1. Agreement
These Terms of Service (“Terms”) govern your use of DM Automata's website, app and related services (the “Service”), provided by DM Automata, A-266, Triveni Nagar, Jaipur, Rajasthan 302018, India (“DM Automata”, “we”, “us”). Our Privacy Policy and Refund & Cancellation Policy form part of these Terms.
These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not require a physical or digital signature. By creating an account, clicking to accept or using the Service, you agree to them. If you use the Service for a business, you confirm you have authority to bind that business.
2. Who can use the Service
- You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872.
- You need an Instagram professional (Business or Creator) account to use Instagram features, and you must be authorised to manage every account you connect.
- You may not use the Service if you are barred from doing so under applicable law, or if we previously terminated your account for breaching these Terms.
3. Your account
- Give accurate information and keep it up to date.
- Keep your login credentials secure and don't share them. You're responsible for activity in your account, including by team members you invite.
- Tell us immediately at [email protected] if you suspect unauthorised access.
4. The Service
DM Automata lets you automate replies to Instagram comments, story replies, story mentions and direct messages; manage an inbox and contacts; publish a link-in-bio page; create app opener links; sell digital products; schedule posts; and view analytics. Features marked “Beta” are still being developed and may change or be withdrawn.
The Service depends on Instagram and other third-party platforms. We do not control them, and changes to their APIs, rules or availability may affect the Service.
5. Instagram and Meta rules
You must comply with Instagram's Terms of Use and Community Guidelines, Meta's Platform Terms and any messaging policies Meta applies. In particular:
- Automations may only respond to people who engaged with your account first — a comment, story reply, story mention or message. You may not use the Service for unsolicited or bulk messaging.
- Follow-up and broadcast messages may only be sent within the messaging windows Meta allows.
- We may throttle, delay or pause sending (for example with hourly caps) to protect your account and comply with Meta's limits.
Meta may restrict, rate-limit or disable an Instagram account or DM Automata's access independently of us. We're not responsible for actions Meta takes, but we'll help where we can.
6. Acceptable use
As required by Rule 3(1)(b) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not host, display, upload, publish, transmit, store or share through the Service any information that:
- belongs to another person and to which you have no right;
- is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, relates to or encourages money laundering or gambling, or promotes enmity between groups on the grounds of religion or caste with intent to incite violence;
- is harmful to children;
- infringes any patent, trademark, copyright or other proprietary right;
- deceives or misleads the recipient about its origin, or knowingly and intentionally communicates misinformation or information that is patently false and untrue or misleading in nature;
- impersonates another person;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States or public order, causes incitement to the commission of any cognisable offence, prevents investigation of any offence or is insulting to other nations;
- contains software viruses or any other code designed to interrupt, destroy or limit the functionality of any computer resource;
- is in the nature of an online game that is not verified as a permissible online game, or advertises or promotes such games; or

You also must not: send spam or unsolicited messages; scrape, reverse engineer or overload the Service; bypass plan limits or security controls; resell the Service without our written permission; or sell illegal, counterfeit or restricted goods through the creator store.
7. Content removal and our role as an intermediary
For content our customers publish (such as bio pages and store listings), DM Automata acts as an intermediary under Section 79 of the IT Act, 2000. On receiving actual knowledge through a court order or a notice from the appropriate Government or its agency, or a valid complaint to our Grievance Officer, we will remove or disable access to unlawful content within the timelines set by law. Complaints about content that exposes a person's private area, shows them in full or partial nudity or a sexual act, or is an impersonation including artificially morphed images, will be acted on within 24 hours of receipt.
We may suspend or terminate users who repeatedly breach these Terms, and may preserve information for investigation where the law requires.
8. Your content and your audience's data
You own the content you create and the data you bring to the Service. You give us a limited licence to host, process and display it only to provide the Service to you.
For personal data of people who interact with your Instagram account, bio page or store, you are the Data Fiduciary under the Digital Personal Data Protection Act, 2023 and DM Automata processes it on your behalf. You are responsible for having a lawful basis to process it, giving any notices required, and handling requests from those people. We'll assist you as described in our Privacy Policy.

12. Our intellectual property
The Service, including its software, design, text and the DM Automata name and logo, belongs to DM Automata and is protected by law. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms. If you send us feedback, we may use it without obligation to you.
13. Third-party services and AI features
The Service works with third-party services such as Instagram, Google, Razorpay, email and storage providers, and integrations you choose to connect. Your use of them is also governed by their own terms.

14. Suspension and termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access, with notice where reasonable, if you breach these Terms, create risk or legal exposure for us or others, fail to pay, or if required by law or by Meta. On termination, your right to use the Service ends and we handle your data as described in our Privacy Policy. Sections that by their nature should survive termination will survive.
15. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”. We don't guarantee that it will be uninterrupted or error-free, that every message will be delivered by Instagram, or any particular business result such as followers, leads or sales.
16. Limitation of liability
To the extent permitted by law, DM Automata will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.
Nothing in these Terms limits any liability that cannot be limited under applicable law, or your rights as a consumer under the Consumer Protection Act, 2019.
17. Indemnity
You agree to indemnify DM Automata against claims, losses and costs arising from your content, your products and sales, your breach of these Terms, or your violation of law or of third-party rights (including Instagram's and Meta's terms).
18. Events beyond our control
We are not responsible for delays or failures caused by events beyond our reasonable control, including outages or changes at Instagram or other third-party platforms, internet or power failures, natural disasters, epidemics, war, strikes or government action.
